DEFINITIONS

Consumer - an adult natural person with full legal capacity, making a purchase from the Seller not directly related to his business or professional activity or an entrepreneur with the rights of a consumer, i.e. a natural person making purchases directly related to his business or professional activity, but not having his / her own business or professional activity professional nature.

Customer - an adult natural person with full legal capacity, a legal person or an organizational unit that is not a consumer within the meaning of the Act on consumer rights.

Buyer - a customer or a consumer purchasing in the online store,

Civil Code - the Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended)

Regulations - these Regulations for the provision of electronic services as part of the Drugi Splot online store.

Online Store - website available at www.drugisplot.pl , through which the Buyer may place orders.

Supplier - an entity that, in cooperation with the Seller, delivers the ordered Products to the Buyer.

Product - goods offered for sale by the Seller in the Store. Product photos are for reference only. The colors and sizes of the Products may slightly differ from those in reality - they depend, for example, on the monitor settings (color saturation and other settings).

Order - Buyer's declaration of intent made through the Store, clearly specifying: the type and quantity of products; type of delivery; payment method; place of delivery of the item, Buyer's data, aimed directly at the conclusion of the contract between the Buyer and the Seller.

Sales contract - a contract for the sale of goods concluded outside the business premises or at a distance within the meaning of the Act on consumer rights of May 30, 2014 in the case of Consumers and a sales contract within the meaning of art. 535 of the Civil Code Act of April 23, 1964 in the case of customers.

Consumer Rights Act - the Act of 30 May 2014 on consumer rights.

GENERAL PROVISIONS

These online store regulations, hereinafter referred to as "Regulations", define the rules for using the online store available at the URL https://drugisplot.pl/.

By using the website drugisplot.pl and / or placing an order, you accept these Regulations ("Regulations"). Before placing an order, read the content of the Regulations.

The owner and administrator of the online store, hereinafter referred to as the Seller, is: Aleksandra Humpich Drugi Splot, ul. Piłsudskiego 28, 21-040 Świdnik, NIP 7122809539, REGON 386927611

The store's activity is the online sale of accessories and children's clothing. The products come from a legal source. Photos of Products do not reflect their natural size. Colors may differ slightly from reality due to differences between screens and computers.

The information contained on the website of the store does not constitute an offer of the Seller within the meaning of the Civil Code, but only an invitation for Buyers to submit offers to conclude a sales contract.

The Seller reserves the right to change the prices of products in the Online Store's offer, introduce new products to the Store's offer, carry out and cancel promotional campaigns on the Store's website or make changes to them, in accordance with these Regulations or the regulations of a given promotion. The introduced changes may not affect the effectiveness and the manner of executing previously placed orders.

Special offers, discounts and promotional codes do not add up, unless the terms of a given promotion specified on the website provide otherwise.

ORDERS

Orders may be placed by natural persons over 18 years of age or by legal persons.

Placing an order does not require registration.

To make a purchase, it is necessary to provide the following data: name, surname, address, e-mail address, telephone number.

All information provided when placing an order should be true and up-to-date. In the event of providing false, out-of-date or questionable data, the Seller attempts to contact in order to complete or verify the data. If it is not possible to contact the Buyer, the Seller reserves the right to withdraw from the order.

The buyer may place orders 24 hours a day. Orders are processed from Monday to Friday (excluding public holidays) from 9am to 2pm (CET).

After placing the order, the Buyer receives an e-mail confirming the order, which means that the sales contract has been concluded.

The Buyer has the right to contact the Store in order to obtain information on the progress of the contract.

Processing the order takes up to 2 business days from the moment the payment is credited to the Seller's account.

It takes 1-5 business days for delivery.

Deliveries are made in Poland. Orders for products with shipments outside Poland are priced individually, and the period of their implementation is up to 14 business days.

All prices listed on the website include VAT.

The final (final) amount to be paid by the Buyer consists of the price for the product and the cost of delivery, about which the Buyer is informed on the Store's website when placing the Order.

The buyer can pay for the order via the Polskie ePłatności website or by bank transfer to the company account. In the case of payment by bank transfer, the Buyer is obliged to make the payment within 2 business days from the date of the Sale Agreement - otherwise it will be canceled. In the case of ePłatności, payments are handled by "Polskie ePłatności" limited liability company based in Tajęcina (formerly "Paylane" sp. Z oo), address: Tajęcina 113, 36-002 Jasionka, KRS: 0000227278, NIP 5862141089 and REGON 220010531.

The invoice for the order is issued at the request of the Buyer. To receive an invoice, the Buyer is obliged to provide the Seller with the necessary data.

COMPLAINTS

The seller is responsible for the non-compliance of the product with the contract under the Act of June 24, 2014 on consumer rights (Journal of Laws No. 2014, item 827).

Complaints may be submitted by e-mail to the following address: drugisplot@gmail.com.

The Seller has 14 working days (from the date of receipt of the notification) to consider the complaint and inform the Consumer about possible solutions.

If the sold Product has a defect, the Consumer has the right to submit a statement requesting a price reduction or submit a statement of withdrawal from the contract, unless the Seller immediately and without undue inconvenience to the Consumer replaces the defective product with a defect-free one or removes the defect.

In the event of returning the Product under complaint, the Consumer receives a refund of the cost of the product (excluding delivery costs) within 14 working days from the date of receipt of the product by the Seller.

The costs of delivery of the product to the Seller are covered by the Consumer. If the complaint is accepted, the costs of delivery are covered by the Seller.

RETURNS

The consumer is entitled, pursuant to art. 27 of the Act of 30 May 2014 on consumer rights, the right to withdraw from the contract without giving a reason and without incurring costs, except for the costs specified in art. 33, art. 34 of the Act of May 30, 2014 on consumer rights.

The deadline to withdraw from a distance or off-premises contract is 14 days from the delivery of the item, and it is enough to send a statement before its expiry to meet the deadline.

To exercise the right of withdrawal, the consumer must inform the seller of his decision to withdraw from this contract by an unequivocal statement (e.g. by e-mail).

The Seller shall confirm to the Consumer by e-mail (provided at the conclusion of the contract and otherwise, if provided in the submitted statement) receipt of the declaration of withdrawal from the contract.

In the event of withdrawal from the contract, the contract is considered void.

The consumer is obliged to return the item to the Seller immediately, but not later than 14 days from the date on which he withdrew from the contract. To meet the deadline, it is enough to return the items before its expiry.

The consumer sends back the items being the subject of the contract from which he withdrew at his own expense and risk to the address provided by the Seller: Aleksandra Humpich Drugi Splot, ul. Piłsudskiego 28, 21-040 Świdnik.

The consumer withdrawing from the contract is responsible for returning the product intact, without signs of use and containing the original tags.

In the event of returning the Product, the Consumer receives a refund of the cost of the product (excluding delivery costs) within 14 working days from the date of receipt of the product by the Seller.

The seller sells upcycled goods, at the same time being obliged to deliver a defect-free item. If the customer finds that the goods have defects, he may return the goods and request a refund; it may also demand a price reduction.

The seller offers upcycled goods, most often in single copies, therefore it is not possible to replace the returned goods with the same or, due to the nature of the goods, to remove the defect. However, the way of exchanging a product is the possibility of exchanging it for another product at the same price.

The customer's claims under the warranty expire after 1 year from the date of delivery of the goods to the customer.

PERSONAL DATA

The administrator of the Buyers' personal data collected via the Online Store is the Seller.

Buyers' personal data collected by the administrator via the Online Store is collected in order to implement the Sales Agreement, and if the Buyer agrees - also for marketing purposes.

The recipients of the personal data of the Buyers of the Online Store may be:

a. In the case of the Buyer who uses the Online Store with the method of delivery by parcel machine or courier, the Administrator provides the collected personal data of the Buyer to the selected carrier or intermediary performing the shipment at the request of the Administrator.

b. In the case of the Buyer who uses the Online Store with the method of electronic payments or with a payment card, the Administrator provides the collected personal data of the Buyer to the selected entity servicing the above payments in the Online Store.

4. The Buyer has the right to access their data and correct them.

5. Providing personal data is voluntary, but failure to provide the personal data indicated in the Regulations necessary to conclude a Sales Agreement results in the inability to conclude this contract.

FINAL PROVISIONS

Agreements concluded through the Online Store are concluded in Polish.

The Seller reserves the right to amend the Regulations for important reasons, that is: changes in the law, changes in payment and delivery methods - to the extent to which these changes affect the implementation of the provisions of these Regulations.

In matters not covered by these Regulations, generally applicable provisions of Polish law shall apply, in particular: the Civil Code; the act on the provision of electronic services; the Act on Consumer Rights, the Act on the Protection of Personal Data.

The buyer has the right to use extrajudicial means of dealing with complaints and redress. For this purpose, he may submit a complaint via the EU ODR internet platform available at: http://ec.europa.eu/consumers/odr/
